Peloton had recalled its Tread+ and Tread treadmills following the death of one child and at least 70 reported injuries. The company also admitted it made a mistake when it initially challenged the Consumer Product Safety Commission’s request to pull its products.
The recall, issued on May 5, 2021, involves Peloton Tread+ treadmills, which comprise the bulk of the recall with roughly 125,000 units in the U.S., and Peloton Tread treadmills, of which there are 1,050 in the U.S. According to information from the CPSC:
Peloton and the CPSC advise consumers to immediately stop using recalled treadmills and to contact Peloton for a full refund until November 6, 2022, after which a partial refund will be available. Peloton is also offering to move consumers’ treadmills to a room that cannot be accessed by children or pets and is implementing software improvements to automatically lock the Tread+ after each use and prevent access by requiring users to enter a passcode.
If you, your child, or a loved one were injured by a Peloton treadmill, you may be entitled to compensation. There have been dozens of reported injuries to children and adult users and one reported child death. While these tragic incidents have led to the latest recall, such recalls do not provide victims who suffer personal injury with compensation needed for medical bills, future medical expenses, lost income, and pain and suffering.
Fortunately, victims have options to pursue a financial recovery of their damages. This includes a products liability claim against Peloton for failing to ensure the safety of its treadmills. Products cases may claim that a product is defectively designed or manufactured, that manufacturers failed to warn consumers about risks, and / or that manufacturers were negligent, among other claims. These cases require thorough investigations and the insight of experts who provide their opinions about defects and whether a safer alternative design was feasible.
